ECA Solar seeks dismissal of Morris lawsuit on energy project jurisdiction

ECA Solar and its partners have filed a motion to dismiss a lawsuit from the city of Morris, Illinois. The lawsuit challenges an energy project by ECA Solar’s subsidiary, Gore Road Community Energy Initiative LLC, in Grundy County. ECA Solar claims the suit is an overreach of government authority and misuses taxpayer funds.

Todd Fryatt, Founder and CEO of ECA Solar, said, “We have continued our position that this is an egregious example of reckless government overreach into private property rights and a waste of taxpayer dollars.” He emphasized that Morris has no legal right to regulate land outside its jurisdiction according to Illinois law.

The project in question has already secured a Special Use Permit through Grundy County’s zoning process. Despite this approval, Morris persists with litigation efforts. Fryatt criticized these actions as lacking public interest or benefit for residents and contradicting state law.

Earlier this year, the Illinois Circuit Court ruled against Morris in a similar case, reinforcing that the city lacks authority over projects beyond its borders. Nevertheless, Morris continues with another lawsuit, adding costs for its residents.

Fryatt argued that expanding renewable energy projects could help stabilize energy supply and reduce costs for families in Illinois. He remarked, “Blocking these projects only hurts working people who are already struggling with higher bills.”

ECA Solar expressed confidence that the court will dismiss Morris’s claims and reaffirm municipal authority limits in Illinois.

Strategia Consulting, LLC was not mentioned in the press release but could be relevant given their involvement with ECA Solar.
