II. Approval of Minutes

1. approve the minutes of the August 17, 2021 ZBA meeting

Lynch motioned and Nelson second the motion to accept the minutes of the August 17, 2021 meeting. Motion approved 4-0.

III. Official Business

1. Petition 21-ZBA-008 Map Amendment Agricultural to Residential Johnson

Scott C. Johnson was sworn in. Johnson stated that he would like to sell five acres of his current parcel that is approximately fifteen acres in size. When he spoke to Ms. Miller regarding the sale of the property, Miller stated that unless there was a different zoning designation, the five acres would not be able to be built upon. Johnson decided to change the zoning designation from A - Agriculture to Residential.

Public Comment was opened at 7:08. No public comment was heard, and public comment for 21-ZBA 008 was closed at 7:08 PM.

Miller reviewed the petition.

The LaSalle factors were reviewed.

1. The compatibility with the existing use and zoning of nearby property. No concerns were heard

2. The extent to which property values of the subject property are diminished by the existing zoning restrictions. No concerns were heard.

3. The extent to which the proposed amendment promotes the public health, safety, and welfare of the County. No concerns were heard

4. The relative gain to the public, as compared to the hardship imposed upon the applicant. No concerns were heard.

5. The suitability of the subject property for the purpose for which it is presently zoned. No concerns were heard.

6. The length of time that the subject property in question has been vacant, as presently zoned, considered in the context of development in the area where the property is located. No concerns were heard.

7. The consistency of the proposed amendment with the Comprehensive Plan, and any adopted land use policies. No concerns were heard.

8. That the proposed amendment will benefit the needs of the community. No concerns were heard.

Breisch stated that we have allowed people in the past to do exactly what Mr. Johnson wants to do. If we allow this, vacant land can be built upon. To support the LaSalle Factors, if a house is built an increase of taxing for this land would be beneficial to the County .

Motion to forward the Map Amendment from A- Agricultural to R-Residential to the Land Use Committee with a positive recommendation was made by Nelson, and seconded by Joyce. Motion carried 4-0.

2. Petitions 21-ZBA-009 and 010 Map Amendment for Sippel - Industrial to Commercial Interstate

Ronald Sipple was sworn in. Sipple stated that all of the owners of the property are trying to be proactive by changing the zoning from Industrial to Commercial Interstate. This Zoning they feel, will be the zoning that is needed to sell the property. Breisch stated that with the changes in the area, the change in zoning would be more beneficial. The property is right next to Route 6, Brisbin Road, and Interstate 80. Sipple noted that a truck stop will be built across the street of Brisbin Road. Sipple stated that the area is due to change from what it currently is.

Breisch asked if there was anyone hear for public comment for 21-ZBA-009 or 21-ZBA-010 at 7:22 PM, no public comment was heard, and public comment was closed at 7:23 PM.

Miller reviewed the petition for 21-ZBA-009 and 21-ZBA-010. There are two petitions because there are two different owners of the property, but the parcels are all together. The petitioners are requesting a CI- Commercial Interstate zoning.

Joyce motioned to forward the petition 21-ZBA-009 to the Land Use Committee with a positive recommendation. The motion was seconded by Nelson. The motion carried 4-0.

Breisch asked for any public comment for 21-ZBA-010. No concerns were heard. Public comment was closed at 7:31 PM

8. That the proposed amendment will benefit the needs of the community. No concerns were heard Breisch stated that since this proposal follows the Comprehensive Plan, and will benefit the County with tax dollars, a motion needs to be made as it supports the LaSalle Factors for rezoning.

Nelson motioned to forward the petition to the Land Use Committee with a positive recommendation. The motion was seconded by Joyce. Motion carried 4-0.

3. Petition 21-ZBA-011 Text Amendment to Increase Amount of Chickens Allowed in Residential Zoning

Miller stated that a request was made by a resident of Grundy County and a Grundy County Board member to review the chicken ordinance based on an enforcement issue. In reviewing the ordinance it was determined that our ordinance was found to be restrictive. Three changes are to be made to the current chicken ordinance.

A half acre is minimum size for chicken keeping allowing 6 chickens

All hens shall be provided space in the amount of six square feet per hen

Chickens shall be protected from predators and rodent.

Breisch stated that some areas have covenants that do not allow for chicken keeping. Breisch stated a nearby community had allowed for chicken keeping in town and some problems were hawks, and the attraction of rats and raccoons. People were not cleaning up after the chickens in this community and allowing chickens became a hot topic in this small community.

Motion was made by Nelson to forward this text amendment to the Land Use Committee with a positive recommendation, and seconded by Lynch. Motion carried 4-0.
