II. Approval of Minutes

1. Zoning Board of Appeals Committee - Public Hearing - Mar 15, 2022 7:00 PM

Breisch asked if there were any additions or subtractions to the minutes. Hearing none the minutes were approved as received.

III. Official Business

1. Variance Petition 22-ZBA-004 Addition Onto Home in Industrial Zoned Property

Miller reviewed the petition. Miller noted that we did not hear any opposition or support of this variance just a letter from Channahon stating they deferred this parcel to the City of Morris.

Jason Brown was sworn in. Brown is asking for a variance because the house has only 2 bedrooms. Brown would like to build an attached garage with a bedroom and a bathroom, because his family is growing and his family needs more room. This is his only plan.

Breisch asked if anyone would like to speak from the public. No public comment was heard. The public comment was closed at 7:08 PM.

Breisch reviewed the hardship Section 8-2-5-30-E.2.b.f.

1. The Zoning Board of Appeals shall not vary the regulations of this title unless it shall make findings based on the evidence presented to it in each specific case that:

a. The plight of the owner is due to unique circumstances.

Breisch noted that a residential home in an Industrial Zoning is a bit unique.

b. the variation, if granted, will not alter the essential character of the locality. Breisch felt this would not be a problem.

2. For the purpose of implementing the above rules, the Zoning Board of Appeals shall also, in making its determination, establish whether there are practical difficulties or particular hardships and take into consideration the extent to which the following facts favorable to the applicant have been established by evidence:

Breisch noted that he knows why the petitioner would want more space, his family is growing.

a. The particular physical surroundings, shape, or topographical condition of the specific property involved would result in a particular hardship on the owner, as distinguished from a mere inconvenience, if the strict letter of the regulations were carried out.

Breisch felt there weren't any concerns

b. the condition on which the petition for a variance is based would not be applicable, generally, to other property within the same zoning district classification. No concerns were heard.

c. The purpose of the variance is not based exclusively on a desire to maker more money out of the property.

It was stated that this does not apply here.

d. The alleged difficulty or hardship has not been created by the owner of the property or by a previous owner.

It was stated that this does not apply here.

e. The granting of the variance will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located.

No issues here

f. The proposed variance will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood.

No issues here.

3. The Zoning Board of Appeals may impose on the permit certain conditions and restrictions on the premises benefited by a variance as may be necessary to reduce or minimize the injurious effect of such variation upon other property in the neighborhood and better carry our the general intent of this title.

Nelson motioned to approve the variance wihout conditions. Joyce seconded. Motion carried. 4-0.
