Coal City Village Board met July 13.

At 7:10 p.m., Mayor Terry Halliday called to order the regular meeting of the Coal City Village Board in the boardroom of the Village Hall. Roll call-Trustees Dave Togliatti, Ross Bradley, Dave Spesia, Tim Bradley and Sarah Beach. Absent was Trustee Dan Greggain. Also in attendance was attorney Mark Heinle, Matt Fritz, village administrator, Police Chief Chris Harseim and Ryan Hansen from Chamlin Engineering
All present recited the pledge of Allegiance.
The minutes of the June 22, 2022 meeting were presented. Spesia moved to approve the minutes as written, second by R. Bradley. Roll call-Ayes; Togliatti, R. Bradley, Spesia, and Beach. Nays; none. Absent; Greggain. Abstain; T. Bradley. Motion carried.
The warrant list was presented. Mr. Fritz asked for an addition to the list in the amount of $1,550.00 for the cost of the band for the Village's Fall Fest. Following discussion, R. Bradley moved to approve the warrant list with the addition of the expense of $1,550.00 for the Fall Fest band, second by Togliatti. Roll call-Ayes; Togliatti, Bradley, Spesia, Bradley and Beach. Nays; none. Absent; Greggain. Motion carried.
There was no Public Comment at this meeting.
Ordinance 22-15, authorizing the sale and Purchase Agreement for the Village owned property at 95 E. Oak Street was presented for approval. Mr. Fritz stated that the sealed bid was opened and the only bidder was Mark Scaggs in the amount of $20,005.00. Attorney Heinle said that the closing could be as soon as thirty days and the property is being sold "as is" with no survey being required. Spesia moved to adopt Ordinance 22 15 authorizing the sale of 95 E. Oak Street to Mark Scaggs for the sale price of $20,005.00, second by Beach. Roll call-Ayes; Togliatti, Bradley, Spesia, Bradley and Beach. Nays; none. Absent; Greggain. Motion carried.
Ordinance 22-16 regarding the keeping of chickens in the Village was reviewed and discussed by the Board. Mr. Fritz stated that the Planning and Zoning Board had reviewed the ordinance extensively, conducted a Public Hearing and is making the

recommendation to the Board for the changes. Mr. Fritz explained the points of the revisions and additions. Several questions and comments arose from the Mayor and Board including:
• Chicken coop to be 30 feet from adjacent property instead of the original 75 feet
• Possible variances to keep chickens in the municipality
• 100 sq. ft. of property per chicken is excessive
• Agreeable with all the other changes
• Omit ducks & geese as permitted fowl
Following discussion, Togliatti moved to Adopt Ordinance 22-16 amending the Village Code regarding the keeping of chickens on residential properties, changing the distance to 75 feet from the adjacent property owner and omitting ducks and geese as allowable fowl, second by R. Bradley. Following discussion and advice from the Village attorney, Togliatti moved to withdraw his motion, second by R. Bradley, Spesia moved to table adopting Ordinance 22-16, second by T. Bradley. Roll call-Ayes; Togliatti, Bradley, Spesia, Bradley and Beach. Nays; none. Absent; Greggain. Motion carried.
Ryan Hansen announced the results of the recent bid letting for the 2022 Motor Fuel Tax (MFT) and non-MFT street maintenance projects for the village. There was only one bidder, on the projects, D Construction of Coal City. Mr. Hansen said that the bids were good numbers and is recommending the Village accept the bids of D Construction. Sidewalk improvements will come through the maintenance department budget at a later date. Spesia moved to award the 2022 MFT Street Project to the lowest responsible bidder, D Construction, in the amount of $309,629.45, second by T. Bradley. Roll call Ayes; Togliatti, Bradley, Spesia, Bradley and Beach. Nays; none. Absent; Greggain. Motion carried. Spesia moved to award the 2022 non-MFT Street Project to the lowest responsible bidder, D Construction, in the amount of $477,946.99, second by Togliatti. Roll call-Ayes; Togliatti, Bradley, Spesia, Bradley and Beach. Nays; none. Absent; Greggain. Motion carried. The non-MFT Street Project will be funded through TIF, Bonds and local funds.
Mr. Fritz presented the estimates for the sludge removal at the sanitary treatment plant which is scheduled every other year. The lowest estimate and contract is from Stewart Spreading with a maximum amount of $99,600.00. R. Bradley moved to select Stewart Spreading as the lowest responsible bidder to the Village's request for pricing and authorized the Village Administrator to enter into a contract for such services, second by Togliatti. Roll call-Ayes; Togliatti, Bradley, Spesia, Bradley and Beach. Nays; none. Absent; Greggain. Motion carried.
Ryan Hansen requested that D Construction be paid for the final payment on the 2021 MFT Street Project. The project is complete and in general compliance. Spesia moved to approve the final payment to D Construction for the 2021 MFT Street Project in the amount of $14,538.61, second by T. Bradley. Roll call-Ayes; Togliatti, Bradley, Spesia, Bradley and Beach. Nays; none. Absent; Greggain. Motion carried..
Mayor Halliday stated that IDOT has announced Rt. 113 to County Line Road will be under construction for improvements,
Togliatti stated that 100 sq. ft. per chicken makes for "Happy Chickens".
Chief Harseim updated the Board regarding the acquisition of a K-9 Dog. Officer Kevin Jones from the Coal City Police Force will become the handler for the dog which is expected in January 2023. The fee of $15,600.00 includes one year of free dog food, training and the expense of the dog will be funded by the Grundy County Sheriff's Department. The K-9 dog will be used for sniffing out illegal drugs and is not a trained bite dog. An MOU (Memorandum of Understanding) is being reviewed by the Village's attorneys, to be presented to the Coal City Police Department Chapter #186 President, Sergeant Jason Clark for approval. Chief Harseim then presented and discussed the recent updated Officer Activity Report and the Grundy County Proactive Unit Report. He also announced that at 10 a.m. on September 14, 2022 in Campbell Memorial Park, the dedication of the "Dennis M. Neary" memorial highway will be held. The Neary family will be present and the public are invited to attend.
Mr. Fritz reported on his meeting with Representative Bennett and the Strategic Planning Meeting held at the Coal City School District on this date. The main topic and concern from that meeting was safety.
