Village of Minooka Planning & Zoning Commission met July 12.

CALL TO ORDER

Meeting was called to order by Chairman Dan Friant at 6:00 PM

PLEDGE OF ALLEGIANCE

CHANGES TO MEETING AGENDA

No changes were made to the meeting agenda.

REVIEW OF PREVIOUS PLANNING & ZONING COMMISSION MEETING MINUTES

Motion was made by Commissioner Wittenkeller to approve the May 17, 2022 Planning and Zoning Commission Meeting Minutes.

Commissioner White seconds.

Abstain: None

BRIEFING ON VILLAGE UPCOMING AGENDA ITEMS

Administrator Duffy stated to the Commission there were no new projects at this time to discuss and would provide further details to be discussed in preparation for the August Planning & Zoning Commission meeting once in New Business.

OLD BUSINESS

Administrator Duffy briefed Commission on Molto moving dirt. They will be building a 1,000,000 square foot spec building. The Ridgeline Property that was previously discussed last year has a site visit with a high-end clean plastic recycler. The recycling company is looking for a 600,000 square foot spec building to setup operations. The Conor Project's financing fell through. Dirt is getting moved near Minooka and McLinden Road in preparation for the new Wal-Mart Distribution Center.

NEW BUSINESS

Public Hearing and Consideration of Case 2022-3 to rezone land from current Kendall County Agriculture zoning classification to Village of Minooka M2 Manufacturing District (LPC Minooka located at the SWC of Holt Road and Wabena Road)

Motion was made by Commissioner Wittenkeller to open the Public Hearing at 6:06 PM.

Commissioner White seconds.

Ayes: White, Wilson, Wittenkeller, Friant

Nays: None

Abstain: None

Absent: Clemmons, Miller, Skwarczynski

Motion carried.

Notice was published on June 23, 2022 in the Joliet Herald News, Morris Herald News and Kendall County Record and notices were mailed to surrounding landowners.

Chairman Friant asked if there were any petitioners or interested persons wishing to testify. No representatives of LPC were present or interested persons to be sworn in by Chairman Friant during the Public Hearing.

Administrator Duffy gave an overview stating LPC Acquisition Company, a Delaware limited liability company is requesting to rezone 58 acres at the southwest corner of Holt Road and Wabena Road from current Agriculture zoning to M2 Manufacturing District. Despite the Village's best efforts to expedite easement agreements with the Conor Project with both ComEd and the Railroad terms could not be negotiated between all parties involved. The Village then spoke to LPC to discuss the utility and road improvement terms that would then be negotiated with them. LPC has asked for a continuation of the public hearing so they have time to review the new information that was presented. Staff recommends continuation of this Public Hearing to the August Planning and Zoning Commission meeting.

Chairman Friant asked if there were any questions or comments from the Commissioners or pubic.

Residents inquired on which side of the road the utility improvements would be located and what the cost would be for the utility improvements down Holt Road to the Davis property. Administrator Duffy responded the North side utility easement was being discussed and he could provide cost figures following the meeting as he did not have exact information in front of him.

No other questions from the Commissioners or public were received. Chairman Friant asked Commissioners if they had enough information to make a decision or if there would be a motion to continue the public hearing.

Motion was made by Commissioner White at 6:16 PM to continue the Public Hearing and Consideration of Case 2022-3 to rezone land from current Kendall County Agriculture zoning classification to Village of Minooka M2 Manufacturing District (LPC Minooka located at the SWC of Holt Road and Wabena Road) to the next Planning & Zoning Commission meeting. Commissioner Wilson seconds.

Public Hearing regarding proposed Ordinance Amending the Village of Minooka Zoning Ordinance to Permit Residential Fence Height Variances

Motion was made by Commissioner Wilson to open the Public Hearing at 6:17 PM.

Commissioner White seconds.

Ayes: White, Wilson, Wittenkeller, Friant

Nays: None

Abstain: None

Absent: Clemmons, Miller, Skwarczynski

Motion carried.

Chairman Friant asked if there were any petitioners or interested persons wishing to provide testimony during the evidentiary hearing. Representatives of Poor Clares of Joliet were present and sworn in by Chairman Friant during the Public Hearing.

Administrator Duffy gave an overview that this is the hearing for code allowance to permit fence height variances. At this time the Village does not have a residential fence variance code for height. Upon further review Administrator Duffy said the Village Attorney recommends the amendment to include all zoning classifications, residential, commercial and industrial fence height variances. Staff has no objections.

Chairman Friant asked if there were any questions or comments from the Commissioners or pubic.

Commissioners discussed that requesters must still present evidence of hardship or unique circumstance and that variance requests would still require approval. Landowners in an HOA would still need to abide by HOA regulations.

Marcos Diaz, representative of Poor Clares of Joliet, stated it would be good for the Village to be able to regulate fence heights. Reference was made regarding a 12-foot-high fence but Administrator Duffy acknowledged if it was located in an unincorporated area that is not governed by the Village of Minooka. Administrator Duffy clarified with Mr. Diaz if he was referencing the fence between Kellogg and the residential properties that the Village does currently allow Industrial zoning allows for an 8 foot fence for screening and that particular fence is on a berm which makes it appear taller.

No other questions from the Commissioners or public were received. Chairman Friant asked Commissioners if they had sufficient information to make a decision or if there would be a motion to continue the public hearing.

Motion was made by Commissioner White to close the Public Hearing at 6:17 PM.

Based on the evidence presented and the reasons set forth in the Planning and Zoning Meeting, Commissioner White motioned to recommend to the Village Board the approval of proposed Ordinance Amending the Village of Minooka Zoning Ordinance to Permit Fence Height Variances in all zoning classifications, residential, commercial and industrial, pending legal review.

Commissioner Wittenkeller seconds.

Ayes: White, Wilson, Wittenkeller, Friant

Public Hearing and Consideration of Case 2022-5 for proposed variance from Title 5, Chapter 11, Section 5-11-6 regarding Fence Height Limitations for the Installment of an 8' Fence (Poor Clares Variance Request - 6200 E. Minooka Road)

Motion was made by Commissioner Wittenkeller to open the Public Hearing at 6:34 PM.

Commissioner Wilson seconds.

Ayes: White, Wilson, Wittenkeller, Friant

Nays: None

Abstain: None

Absent: Clemmons, Miller, Skwarczynski

Motion carried.

Administrator Duffy notified the Commission that based upon their previous recommendation to the Village Board the approval of proposed Ordinance Amending the Village of Minooka Zoning Ordinance to Permit Fence Height Variances in all zoning classifications, staff has no objections for the Poor Clares 8 foot fence variance request.

Marcos Diaz, representative of Poor Clares, gave a brief overview of the fence variance request as depicted in submitted photos with the Commission.

Mother Maria Benedicta Murphy, Poor Clares President, expressed the need for this variance for security purposes as required for the Monastery. The height would also assist with noise levels.

No other questions from the Commissioners or public were received. Chairman Friant asked Commissioners if they had sufficient information to make a decision or if there would be a motion to continue the public hearing.

Motion was made by Commissioner Wilson to close the Public Hearing at 6:51 PM.

Based on the evidence presented and the reasons set forth in the Planning and Zoning Meeting and recommendation sheets, Commissioner White motioned to recommend to the Village Board the approval of Case 2022-5 for proposed variance from Title 5, Chapter 11, Section 5-11-6 regarding Fence Height Limitations for the Installment of an 8' Fence (Poor Clares Variance Request - 6200 E. Minooka Road) pending legal, final engineering and site plan review.

Commissioner Wilson seconds.

AS APPROPRIATE

Commissioner White noted that Prime, Inc. done a terrific job on the fence and landscaping. Administrator Duffy agreed and stated the Village will use it as an example for future projects.

Commissioner Wittenkeller inquired about Unlimited Carriers and Administrator Duffy updated him that the annexation was approved at the May Village Board meeting. Dirt should be moving soon.

PUBLIC COMMENT

None were received.

ADJOURNMENT

Motion was made by Commissioner Wilson to adjourn the Planning and Zoning Commission meeting at 7:00 PM. Commissioner Wittenkeller seconds. Motion carried with all ayes.
