Illinois State Police (ISP) officials have recently concluded a series of hearings on a contentious component of the state's new "Assault Weapon" ban. The law, which prohibits the possession of various firearms and firearm attachments, allows current owners to retain their weapons if purchased prior to January 23, 2023, and if they complete an endorsement affidavit.
To enforce the affidavit requirement, ISP filed an emergency rule that was reviewed by the Joint Committee on Administrative Rules (JCAR). In collaboration with the agency, lawmakers on JCAR agreed to hold hearings on the proposed rule before its implementation.
The first hearing took place in Springfield on November 2, followed by another in Chicago the next day. The final hearing was held in Caseyville on November 6. During these hearings, numerous individuals voiced their concerns and posed questions regarding the conflicting and confusing language within the law itself, particularly regarding the specific models of firearms and accessories affected.
While ISP officials did not provide immediate answers to these inquiries during the hearings, attendees were encouraged to submit their questions in writing. They were assured that their questions would be addressed at a later date. State Senator Sue Rezin, a vocal advocate for the Second Amendment rights of law-abiding gun owners, expressed her dissatisfaction with the confusion surrounding the new rule. She had voted against the ban and believes that its constitutionality will be challenged in federal courts, where several lawsuits are currently pending.
The hearings conducted by ISP and JCAR provide an opportunity for concerned individuals to express their opinions and seek clarification on the new gun ban rule. The contentious nature of the law and the confusion surrounding its language reflect the ongoing debate over gun control and individual rights.
