Village of Diamond Village Board of Commission met Nov. 14.

Here are the minutes provided by the commission:

Proceedings, transactions, and resolutions made and order of said record of said Board in the Village of Diamond, IL on the 14th day of November 2023.

The scheduled meeting of the Diamond Village Board was held on Tuesday, November 14, 2023, at 6:00 p.m. with Mayor Teresa “Terry” Kernc presiding. Upon roll call Commissioners present were Mark Adair, Dean Johnson, and Jeff Kasher. Absent: Dave Warner.

Approval of 10-24-2023 Minutes

MOTION was made by Commissioner Johnson, SECOND by Commissioner Adair to approve the 10/24/2023 regular meeting minutes and place on file. Abstain: Adair: Ayes: Johnson, Kasher and Kernc. Motion Carried.

Approval of November 14, 2023, Bill List

MOTION was made by Commissioner Kasher, SECOND by Commissioner Johnson to approve the November 14, 2023, bill list and place it on file. All Ayes: Motion Carried.

Approval of the October 2023 Treasurer’s Report

MOTION was made by Commissioner Kasher, SECOND by Commissioner Johnson to approve the October 2023 Treasurer's Report. All Ayes: Motion Carried.

New Business

Approve 2023-24 Intergovernmental Agreement with Grundy County Animal Control Mayor Kernc stated this is money well spent. MOTION was made by Commissioner Johnson, SECOND by Commissioner Adair to Approve the 2023-24 Intergovernmental Agreement with Grundy County Animal Control in the amount of $2,994.00. All Ayes: Motion Carried.

Sewer Charge Adjustment-180 S. Will Road

Village Clerk Lori Holmes stated this resident had 2 outside faucets which were leaking and did get repaired. However, Holmes is requesting credit due to the water being ground water and did not enter the village sewer system. Based on estimated usage, Holmes is requesting a credit of $111.50. MOTION was made by Commissioner Adair, SECOND was made by Commissioner Kasher to approve sewer credit in the amount of $111.50 to 180 S. Will Road. All Ayes: Motion Carried.

Approve Ordinance #2023-07, Amendment to the Liquor License

Village Attorney John Gallo stated this was discussed at the October 24, 2023, meeting to revise and add a new classification of Class A-1. This will allow the two existing video gaming businesses to continue serving their patrons as they have done in the past under the old classification. MOTION was made by Commissioner Johnson, SECOND by Commissioner Kasher to Approve Ordinance #2023-07, Amending Chapter 110, Alcoholic Liquor Dealers, of the Code of Ordinances of the Village of Diamond. All Ayes: Motion Carried.

Approve Resolution #2023-08, Regarding Surface Transportation Program-Local Funding for Will Road, From IL 113 South to Spring Road

Mayor Kernc stated this must be completed for every application completed for funding. MOTION was made by Commissioner Kasher, SECOND by Commissioner Adair to Approve Resolution #2023-08, Regarding Surface Transportation Program-Local Funding for Will Road, From IL 113 South to Spring Road. All Ayes: Motion Carried.

Approve Pay Application and Change Order for Water Meter Replacement/Ferguson Waterworks

This item was tabled.

Approve Pay Application No. 3 for United Meters/Water Meter Replacement Village Engineer Mike Perry stated the request is in the amount of $15,789.60 for progress of the installation of the water meters. This is approximately 15-16% of the total due for the entire contract. MOTION was made by Commissioner Adair, SECOND by Commissioner Kasher to Approve Pay Application No. 3 for United Meters/Water Meter Replacement in the amount of $15,789.60. All Ayes: Motion Carried.

Approve Shenberg Construction Proposal for 1752 E. Division St.

Mayor Kernc stated this is for roof replacement, vents, fascia, gutters, downspouts etc. as reflected in the proposal. Kernc added, all maintenance free materials will be installed. MOTION was made by Commissioner Johnson, SECOND by Commissioner Kasher to Approve Shenberg Construction Proposal for 1752 E. Division St. in the amount of $14,180.00. All Ayes: Motion Carried.

Diamond I-55 TIF Discussion

Mayor Kernc stated the Braidwood and Wilmington Fire Protection Districts had previously met with Kernc and asked for additional revenue due to new construction in the TIF district. Monies are frozen even when the EVA increases, the village receives the increase of the EAV however, those districts do not. All new construction in those areas does increase service calls for those districts. The Braidwood Fire Chief met with Kernc to discuss specifically what he would like Kernc to discuss with Jewel/TBS as Kernc is obligated to do so per the ordinance. He would like Kernc to ask for a permit donation of $1.00 per square foot as a one-time fee which would be $62,000.00. In addition, he would like $.50 per square foot every year or $31,000.00 for each year for the life of the TIF. Any of these conditions is recommended and is not enforceable. Kernc recommends the village comprises a letter to present to Jewel for a one-time permit donation of $.25 per square foot and a $.10 per square foot as a yearly donation until the TIF expires. All donations will be paid directly to the Fire Protection District, and this is a good neighbor recommendation only and it is not enforceable. Commissioner Kasher inquired how long is the TIF in place and Kernc stated 12 more years at which that time, could be extended. Kernc feels if areas are built out, it will not be necessary. Otherwise, areas developed by 2025 will be removed if extension is sought. Kernc will not be Mayor at that time so this is only her suggestion. Commissioner Adair stated, when the TIF was developed, those districts were in support of it, therefore knew development would eventually be coming. Village Attorney John Gallo stated the village adopted an ordinance which stated when a development comes into the TIF district, the mayor will facilitate a meeting between the taxing district and the developer. Kasher is opposed to the additional yearly donation and is only in agreement for the presentation for the one-time donation as a goodwill gesture. After discussion, the Commissioners agreed to present the one-time $.25 per square foot for the permit donation and with no additional yearly donations. MOTION was made by Commissioner Johnson, SECOND by Commissioner Adair, to approve Kernc to present the fee recommendation with the additional TIF paperwork in her meetings with developers and the Fire Protection Districts.

Clearwave Fiber Discussion

Mayor Kernc stated this company reached out to Building Administrator Cindy Haywood regarding their company to install fiber throughout the village. It was unanimous that this company must present to the Board their project. This item was tabled.

Grundy and Will County Sheriff’s Monthly Update

Mayor Kernc stated there was nothing out of the ordinary to report.

Engineer Updates

Public Works Department Updates

Public Works Supervisor Jim Dunning reported the wash press solenoid was installed. New flow meter ordered for WWTP. Dunning contacted Bonfield regarding a reference check on Joe’s well for the pressure tanks. They highly recommend them. The computer at the sewer plant wasn’t working again and it was due to a faulty RAM drive in the system. It has been replaced and it is back in operation. The SCADA system will be programed on the 16th. The speed sensor on the backhoe was installed. The EPA will be at the plants this week.

Clerk Updates

Village Clerk Lori Holmes stated someone came in and asked if the village could display information regarding an event in Morris. Holmes feels that the marquee should reflect events, etc. pertaining to Diamond residents only. After discussion, the decision was made that only local advertisements will be displayed on marquee supporting schools, scouts etc. not events outside the village. Other items will be listed on the village website.

Commissioner Johnson noticed the path is completed on Will Road. Johnson also inquired about the open culverts on Will Road and if those will be enclosed. Kernc stated if the village receives the grants, then the culvert will continue. If not, Kernc is pursuing some type of grating to be placed over it. Johnson asked about the rental car facility and Holmes stated they changed their name and she spoke with the new manager regarding sales and changing the tax location so the village will receive the dollars due.

MOTION was made by Commissioner Kasher, SECOND by Commissioner Adair to release the following closed session minutes: 11-22-2022; 4-25-2023; 5-23-2023 and 8-22-2023. All Ayes: Motion Carried.
