Proceedings, transactions, and resolutions made and order of said record of said Board in the Village of Diamond, IL on the 22nd day of October 2024.
The scheduled meeting of the Diamond Village Board was held on Tuesday, October 22, 2024, at 6:00 p.m. with Mayor Teresa “Terry” Kernc presiding. Upon a roll call Commissioners present Mark Adair, Jeff Kasher and Dave Warner. Absent: Dean Johnson.
Approval of 10-08-2024 Minutes
MOTION was made by Commissioner Warner, SECOND by Commissioner Kasher to approve the 10-08-2024 meeting minutes and place on file. All Ayes: Motion Carried.
Approval of October 22, Bill List
MOTION was made by Commissioner Kasher, SECOND by Commissioner Adair to approve October 22, 2024, bill list and place it on file. All Ayes: Motion Carried.

Approve Ordinance #2024-16, Granting Certain Variances from the Zoning Code (Case #PZ-02-2024-2025 Crown Court)
Zoning Administrator Cindy Haywood stated the Planning and Zoning Board met preceding this meeting and it was approved unanimously for the variance. Haywood stated the variance was needed due to a portion of the solar panels would be facing the front of the house. Commissioner Adair inquired about this requirement. Haywood stated based on the energy requirements of the household, they required more panels. The homeowner has an electric vehicle which added to the higher energy requirements for additional solar panels. MOTION was made by Commissioner Warner, SECOND by Commissioner Kasher to Approve Ordinance#2024-16, Granting Certain Variances from the Zoning Code (Case #PZ-02-2024-2025 Crown Court). All Ayes: Motion Carried.
Approve Amendment to Ordinance #2024-05, Repealing and Replacing Chapter 110, Alcoholic Liquor Dealers, of the Code of Ordinances
Village Attorney John Gallo stated this amendment is applicable to grocery stores only. The serving size of the original ordinance was 3 samples of ¼ ounce for liquor sampling. Jewel will be hosting cooking classes with pairings of wine, beer and spirits; therefore, the serving sizes were increased to accommodate 3 samples of ½ fluid ounces of distilled spirits, 5 ounces of wine and 12 ounces of beer. The MOTION was made by Commissioner Adair, SECOND by Commissioner Warner to Approve Amendment to Ordinance #2024-05, Repealing and Replacing Chapter 110, Alcoholic Liquor Dealers, of the Code of Ordinances. All Ayes: Motion Carried.
Approve and Accept Lowest Bid to Build and Install Aeration Tank Walkway at WWTP Village Engineer Mike Perry stated the village did not receive any bids on this project. The bid period has been extended for two additional weeks. This Item was tabled.
Approve and Accept Low Bidder for Public Works Maintenance Building Village Engineer Mike Perry stated the village received 2 bids. The lowest bid was from Blunier Builders. Bid for the 60x120 building the bid amount was $242,950.00. The alternate bid for a 60 x 136 building with 2 additional bays was in the amount of $251,950.00. Alternate deduction of $7,000.00 for eves. MOTION was made by Commissioner Kasher, SECOND by Commissioner Adair to Approve and Accept Blunier Builders alternate bid for the Public Works Maintenance Building in the amount of $ 251,950.00 with the $7,000.00 deduction. All Ayes: Motion Carried.
Approval of Fastsigns in the amount of $ 509.38 for the Village Logo Signs for buildings Mayor Kernc stated consensus was given and this needed formal approval. Commissioner Kasher questioned the amount on the bill list reflected a check in the amount of $559.38 not $509.38. Kernc stated the additional $50.00 was for the stainless-steel hardware required to install the signs. MOTION was made by Commissioner Kasher, SECOND by Commissioner Warner to Approve Fastsigns Village Logo Signs for village buildings in the amount of $559.38. All Ayes: Motion Carried.
Approval of Conference Travel Expense for John Guistat: Overnight Hotel/Travel Expense for Operator Training in Water/Wastewater Operations
Mayor Kernc stated this is for continued training needed to obtain hours for his operator license. Kernc added Guistat received a scholarship for the cost of the conference training. MOTION was made by Commissioner Warner, SECOND by Commissioner Adair to Approve Conference/Travel Expense for John Guistat: Overnight Hotel/Travel Expense for Operator Training in Water/Wastewater Operations. All Ayes: Motion Carried.
Approve Ariens Mammoth 850 Snow Remover for Sidewalks
Mayor Kernc stated with the installation of the multi-use path as well as the bike path, she wanted some type of machinery which would be able to clear/shovel these paths during the winter. Commissioner Kasher stated he is not in agreement with this snow remover equipment. It does not have an enclosed cab. An employee would have to stand on it in in-climate weather to operate this machinery. Kasher stated there is a used John Deere with a heated enclosed cab which has 800 hours on it. It also has a sweeper and snow blower attachments. This item is currently at auction. He spoke to the municipality in Ohio which has listed the equipment on auction. After further discussion, a consensus was given for Kasher to bid on this item not to exceed $20,000.00.

Public Works Supervisor Jim Dunning was absent, however Mayor Kernc stated Wren Construction removed the old blower out of WWTP and Meade Electric will be installing the new one which needs to be installed by December 1.

Commissioner Kasher
Commissioner Kasher stated the furnace did not need to be replaced. He contacted another heat/air company, and they were able to find items which were disconnected during the roof and siding installation. Kernc stated Shenberg Construction will be paying for the cost of the heat/air invoice. Kasher stated he will be able to get the dirt needed for the village hall grounds for free. He will be in contact with Dunning regarding the pickup.
Commissioner Warner
Commissioner Warner inquired about the sidewalk repairs. Village Engineer Mike Perry stated P.T. Ferro will be completing the repairs, however, they will not be completed before winter. They will be placing drainage pipes in those areas.
Mayor Kernc
Kernc stated she read how the Village of Coal City is limiting the tobacco and vape shops allowed in their village. Kernc would like to do something similar in Diamond. Diamond has 2 standalone tobacco stores since the recent closing of the third shop. After discussion, consensus was given to amend the current ordinance to limit tobacco licenses for the stand alone stores only. Village Attorney John Gallo will amend the ordinance and present it to the board for formal approval.
