Coal City Village Board met May 10.

Here are the minutes provided by the board:

at 5:30p.m. in the boardroom of the Village Hall, Mayor Terry Halliday called to order the meeting of the Coal City Village Board. Roll call-Trustees Dave Togliatti, Dan Greggain, Tim Bradley and Sarah Beach. Absent; Dave Spesia and Ross Bradley. Also in attendance were Matt Fritz, village administrator, Chris Harseim, police chief, Matt Halloran from Chamlin engineering and attorney Bryan Strand.

All present recited the pledge of Allegiance.

The minutes of the April 27, 2022 Public Hearing were presented. Togliatti moved to approve the minutes as written, second by Greggain. Roll call-Ayes; Togliatti, Greggain, T. Bradley and Beach. Nays; none. Absent; R. Bradley and Spesia. Motion carried.

Clerk Noffsinger swore-in Kolton Stockdell as a new member of the Coal City Police Force. Mayor Halliday thanked the Fire & Police Board of Commissioners for expediting the acquisition of three new officers whom were sworn-in at the last two Village Board Meetings, Mike Lareau of the Fire & Police Board said that the selections were the efforts of a good Fire & Police Board, along with the support of Chief Harseim and Trustee Greggain.

Ordinance 22-07 a conditional use permit request at 301 S. Broadway was presented to the Board for consideration. Mr. Fritz stated that the petitioners are making the request to utilize the 6,000 square foot building for the sale of liquor and tobacco along with a restaurant. The request was reviewed and approved by the Village's Planning and Zoning Board following Public Hearings. The property is zoned C-4 and a Conditional Use is required in order to serve beverages without live entertainment. Togliatti moved to adopt Ordinance 22-07 granting a conditional use at 301 S. Broadway to allow a restaurant serving alcohol without live entertainment, second by Greggain. Roll call-Ayes; Togliatti, Greggain and Beach. Nays; T. Bradley. Absent; R. Bradley and Spesia. Motion carried.

Ordinance 22-08 increasing the total number of liquor license permits to allow a Class B license and a Class C license was presented to the Board. Mr. Fritz explained that the petitioners of 301 S. Broadway have acquired the property and are planning on opening a liquor and tobacco store, restaurant serving alcohol with no live entertainment and gaming machines. These options require two liquor licenses. The Class B liquor license is for the retail sale of packaged liquor and alcohol and the Class C liquor license is required in order to serve alcohol in the restaurant. The Class C license will allow the petitioners to provide gaming machines within the location. Togliatti moved to adopt Ordinance 22-08 creating two additional liquor licenses-one Class B and another Class C for the operation of Blue Taco at 301 S. Broadway, second by Greggain. Roll call-Ayes; Togliatti, Greggain and Beach. Nays; T. Bradley. Absent; R. Bradley and Spesia. Motion carried,

Ordinance 22-09, a variance request at 90 S. Kankakee was presented to the Board for approval. Mr. Fritz explained that the petitioner, Thomas Beck who was present for the meeting, was requesting a corner side yard variance for the construction of a 6 foot fence on the property located on the corner of S. Kankakee Street and Carbon Street, and along the north/south alley between S. Kankakee Street and S. Broadway. To accomplish this, an 18 foot variance is required from the code requirement of a 25 foot setback. A7 foot setback will exist from the edge of the sidewalk and 5 foot from the edge of the alley. The fence will not obstruct any line of sight. The Village's Planning and Zoning Board reviewed the request and is making the affirmative recommendation to the Village Board. Greggain moved to adopt Ordinance 22-09 granting a variance to construct a fence within the corner side yard at 90 S. Kankakee Street, second by Beach. Roll call-Ayes; Togliatti, Greggain, T. Bradley and Beach. Nays; none. Absent; R. Bradley and Spesia. Motion carried.

Ordinance 22-10, a variance request for a fence at 410 W. Oak Street was presented to the Board. Mr. Fritz stated that the petitioners own the home located at the corner of W. Oak Street and Marguerite Street, Mr. and Mrs. Salvador Reyes, present at this meeting, are requesting the corner side yard variance that would allow a 24 foot variance along West Oak Street, due to the smaller lot and the fence would then be placed 2 feet from the sidewalk. Their property line lies 18 inches from the back of the sidewalk. The Village's Planning and Zoning Board reviewed the request, a Public Hearing was held with no oppositions heard, and are making the recommendation for approval to the Village Board. Togliatti moved to adopt Ordinance 22-10 granting a variance to construct a fence within the corner side yard at 410 W. Oak Street, second by Greggain. Roll call Ayes; Togliatti, Greggain, T. Bradley and Beach. Nays; none. Absent; R. Bradley and Spesia, Motion carried.

Ordinance 22-11, an ordinance requesting a variance at 460 N. Fifth Avenue for the construction of a storage building without a masonry accent band, was presented for consideration by the Village Board. Mr. Fritz said that the construction of the under 12,000 square foot storage building is allowed within that zoning area, however, a masonry band on the building is required per the Village's code, but the building will be located 400 feet off Fifth Avenue and Mr. Alderson, the petitioner, would design the building with two shades of siding as presented in the diagram distributed. The building will consist of 25 large storage units, 10 feet high and 10 feet wide. The variance was presented to the Coal City Planning and Zoning Board and they unanimously approved the request. Greggain moved to adopt Ordinance 22-11 granting a variance to allow the construction of a metal-clad industrial storage building at 460 N. Fifth Avenue, second by Beach. Roll call-Ayes; Togliatti, Greggain, T. Bradley and Beach. Nays; none. Absent; R. Bradley and Spesia. Motion carried.

Discussion was held regarding the 2022 Street Rehabilitation Program. Mr. Fritz stated that the Street and Alley Committee have not reached a final determination on the exact road choices to fall within the 2022 program, but that the Board could consider the approval of the Engineering Services Contract with Chamlin Engineering to begin the program process. The approval of the streets/alleys to be addressed in 2022 will be presented to the Board at a later date. T. Bradley moved to authorize Mayor Halliday to enter into engineering agreements with Chamlin Engineering to allow the design and bid for the Village's annual street paving program, second by Greggain. Roll call-Ayes; Togliatti, Greggain, T. Bradley and Beach. Nays; none. Absent; R. Bradley and Spesia. Motion carried,

Mayor Halliday thanked the Police Department and the Fire & Police Board of Commissioners for expediting the addition and hiring of three new officers to the police force. New officer, Brandon Larson is in field training and new officer, Connor Goron is in the police academy presently and new officer, Kolton Stockdell will enter the academy beginning May 22nd

Chief Harseim included the monthly police statistics in the Village Board packets. He distributed the activity report for the Grundy County Proactive Unit from March 2021 until present. He noted how successful the unit is.

Mr. Fritz congratulated the award recipients, the Coal City Public Library and Lori Bonarek Realty given at the annual GEDC/Grundy County Chamber Annual Award Banquet. The Village received notification of the $1m grant award from DCEO for the 2nd Avenue Storm water project. It is not known when the Village will receive the funds. A Water & Sewer Committee meeting will be scheduled in the near future.
