II. Approval of Minutes

Breisch asked if there were any changes or additions to the September 20, 2022 minutes. Hearing none, the minutes will stand approved as written.

III. Official Business

1. Special Use for a Mini Storage for Paravola; 3115 Rte 47

Chairman Breisch read the petition and asked Miller to read the summery attached, she gave a synopsis of what their intentions were for the property located at 3115 N Rt 47, Morris. Mr & Mrs Paravola were both sworn in.

The public hearing was opened.

Mr Russell spoke expressing his concerns for the water issue they have has at their property they believe is from the previous owners initial building at that location, but has no issue with the Paravola's intent for the property. Second Mrs Mitoraj spoke of the same issue, water and the lack of drainage. After that Mrs Svetteazh spoke also about the water and drainage and said she did not have an issue with the business unless they were building up the property.

Miller stated they (Miller and the Administrator Mary Kucharz) will have a meeting with Mr. Russell and Mrs. Mitoraj.

Time for public comment was closed at 7:50pm.

2. The extent to which property values of the subject property are diminished by the existing zoning requirement. - No

3. To the extent to which the proposed amendment promotes the public health, safety, and welfare of the county. - No

4. The relative gain to the public, as compared to the hardship imposed upon the applicant. - No

5. The suitability of the subject property for the purpose for which it is presently zoned. No

6. The length of time that the subject property in question has been vacant, as presently zoned, considered in the context of the development in the area where the property is located. No

7. The consistency of the proposed amendment with the Comprehensive Plan, and any adopted land use policies. - No

8. That the proposed amendment will benefit the needs of the community. - No

The owners agreed with the following 6 conditions put forth:

1. Owner shall ensure that the lighting for the facility does not shed onto other adjacent properties or onto Route 47 and that any glare is diffused through the use of light shields.

2. Owner shall install and improve current landscaping for the front of the mini-storage facility and the outside storage.

3. All landscaping, fencing, and parking areas shall be properly maintained at all times.

4. A Knox Box complying with requirements of the Morris Fire Department shall be installed.

5. Owner shall provide a minimum of twenty-five (25) feet of clearance to access the front and sides of the mini-storage facility.

6. Owners shall instruct all renters of the space that they are not allowed to store materials that are prohibited as stated in Section 8-2-5-18 I.

No old business was heard.

V. New Business

1. Resignation of Sid Nelson from ZBA and Replacement

Sid Nelson put in his resignation on Feb 7, 2022. It is known to all another person needs to take his spot. It was the consensus of the committee that they will ask around for an interested party within the County and if they do not get any interest will post the open spot in the paper.
