Village of Minooka Planning & Zoning Commission met March 14.

Here are the minutes provided by the commission:

On Tuesday, March 14, 2023, at 6:00 P.M. the Village of Minooka Planning and Zoning Commission (the “Plan Commission”) conducted a public hearing, with public notice having been duly given for the same. At that hearing, the Plan Commission considered an application seeking a conditional permitted use permit (the “Permit”) authorizing the use of certain property, located within the corporate boundaries of the Village and bearing the current PIN: 03-01-301- 001-0000 (the “Subject Property”), for the purposes of a drive through pursuant to Section 5-7- 3(B) of the Village’s zoning ordinance (the “Proposed Use”). The Subject Property is presently zoned B-1 (Business District). Having heard and considered all of the evidence presented at the hearing and being fully advised in the premises, the Plan Commission hereby finds that the applicant has sufficiently demonstrated that:

a. The Proposed Use is compatible with the existing uses of surrounding land in the general area surrounding the Subject Property; and

b. The Proposed Use is not inconsistent with the zoning classifications of other property within the general area of the Subject Property; and

c. The Subject Property is suitable for the uses permitted under its existing zoning classification of B-1 (Business District); and

d. The Proposed Use is not inconsistent with the trend of development in the general area of the Subject Property; and

e. The Proposed Use and the Subject Property’s existing zoning classification of B-1 (Business District) are not inconsistent with the official comprehensive plan of the Village; and

f. The approval of the Permit is in the best interests of the public and not solely in the applicant’s interest; and

g. The Proposed Use is necessary and desirable on the Subject Property and will likely provide the Village and its residents with services that are convenient and beneficial to the public; and

h. The Permit (and the Proposed Used to be operated thereunder) will likely contribute to the general welfare of the surrounding neighborhood or community; and

i. The Proposed Use is not likely to be detrimental to the health, safety, morals, or general welfare of persons residing or working in the vicinity of the Subject Property; and

j. The Proposed Use is not likely to be injurious to property values or improvements in the vicinity of the Subject Property; and

k. The Proposed Use is otherwise consistent with and meets all standards and requirements set out in the Village’s code of ordinances, as amended.

Based on the foregoing findings, the Plan Commission hereby recommends that the Corporate Authorities of the Village approve the applicant’s request and adopt an ordinance granting a conditional permitted use permit authorizing the operation of a drive through on the Subject Property, subject to the following conditions:

1. Compliance with Village Ordinances and Codes: All improvements on the Subject Property shall comply with all Village Ordinances, including but not limited to the Village’s building and technical codes, as amended from time to time.

2. Vehicle Stacking and Drive Aisles: Operation of the drive-thru on the Subject Property, including without limitation any vehicle stacking caused thereby, shall not be permitted to interfere with (i) access to and from Ridge Road from the Subject Property or (ii) cross-access to any and all other business(es) located on the Subject Property. At all times that the drive-thru permitted by this Ordinance is in operation, the Applicant shall ensure that vehicles are not permitted to stack in any location other than the permitted stacking area shown on Exhibit ___, attached hereto. The access drive aisle located behind the building on the Subject Property shall be made into a one-way drive aisle proceeding to the north and east (i.e. toward W. Mondamin Street) and the Applicant shall, prior to commencing business operations on the Subject Property, install and maintain (subject to final Village approval) signage as necessary to notify the motoring public of said access drive aisle’s one-way status.

3. Compliance with Plans and Standards: The Applicant’s construction and operation of the proposed Chipotle restaurant with a drive-through facility shall incorporate and comply with: the site plan, building elevations, and renderings attached as Exhibit ___.

4. Landscape Plan: The Applicant shall not substantially alter any existing landscaping on the Subject Property and will restore or replace any such landscaping as may be damaged or removed during construction activities related to the proposed drive-through.

5. Crosswalk Improvements: Prior to commencing business operations, the Applicant shall install signage and protective railings around, stripe the pavement of, and install mirrors near the crosswalk that crosses the end of the proposed drive-through tunnel and connects the Chipotle restaurant with the rest of the shopping complex located on the Subject Property as necessary to protect the health and safety of both pedestrians and drivers (all subject to final Village approval). Thereafter, the Applicant shall be responsible for maintaining all such signage, railings, striping, and/or mirrors in reasonably good condition.

6. Drive-Through Maintenance: The Applicant is and shall be responsible for maintaining the drive-through and all appurtenant improvements. The drive-through shall be maintained at all times in a clean, presentable, and safe condition, free of any litter or debris.

7. Drive-Through Ventilation: At all times that the drive-through is in operation, it shall have adequate ventilation in compliance with all federal, state, and local laws, rules, and/or regulations.

8. Hours of Operation: Hours of operation for the Chipotle restaurant shall be restricted as follows: 10:00 a.m. to 10:00 p.m., seven days per week.

9. Drive-Through Lighting: Prior to the Chipotle restaurant commencing business operations, the Applicant shall install lighting fixtures as necessary to adequately light the drive-through facility to the satisfaction of the Village. At all times after the Chipotle restaurant commences business operations, the drive-through facility on the Subject Property shall be adequately lit at all times, including at night when the Chipotle restaurant is closed for business.

10. Online Ordering: There shall be no microphone and/or amplified speaker system (e.g. no “squawk box”) installed or used as part of the drive-through facility and the Applicant shall not permit orders to be made at the drive-through window. Rather, all orders shall be made in advance via the internet.

11. Engineering Approval: The approval of the conditional permitted use is subject to the Village’s approval of final engineering.
