II. Approval of Minutes

1. Zoning Board of Appeals Committee - Public Hearing - Jul 18, 2023 7:00 PM Unanimous Vote to approve July 18, 2023 minutes as standing approved.

III. Official Business

1. 23-ZBA-009 Special Use for a Solar Farm for Industrial Nouron Use

Chairman Breisch read the petition and asked Miller to read the summery attached, she gave a synopsis of the petition Nouryon would like to do with the use of the solar field on their property located at 8005 N. Tabler Rd. Amanda Henry was sworn in to speak. This is a solar only project to supply energy souly to Nouryon facility, no power will be sold back to the grid. Skwarczynski questioned if they are standard solar panels, Henry can not confirm "standard" other then the components are similar to other. Skwarczynski questioned the coating, Henry explained the coating is baked on to the glass surface, does not believe will effect water source. Skwarczynski asks if american made, Henry stated they are not, its forgein. Sandeno asked life expectancy, Henry stated 15-20 years and the contract with Nouryon is 15. Miller asked if they are ethicly source, they are. Sandeno questions the size requirements, Miller explained the difference. Skwarczynski EPA approved panels? Breisch wanted to know if the panels meet the quality for the United States requirements. Henry will verify testing processes. No public Comment. Public comment closed.

Skwarczynski asked miller about conditions. Miller stated the conditions are the same as the others. There are no issues with any of the Lasalle factors. Skwarczynski concerned about wildlife and lighting conditions need to be placed in the conditions, Miller will add to conditions.

2. 23-ZBA-008 Map Amendment AR-Agricultural Residential to I-Indistrial Burns Storage

Chairman Breisch read the petition and asked Miller to read the summery attached, she gave a synopsis of the petition map amendment to be rezoned from AR- Agricultural Residential to I-Industrial apporximatley 40x196 foot section to allow for existing storage. Michael Flemming is sworn in to speak for Burns Storage, he explains that they need to fix a clerical error on the lot line to prepare it for sale. There was no public comment. There was no questions from the board. There were no issues with any of the Lasalle factors.

3. 23-ZBA-010 Map Amendment from I-Industrial and R-Residential to A-Agricultural Hatcher

Chairman Breisch read the petition and asked Miller to read the summery attached, she gave a synopsis of the petition for Map Amendment from I-Industrial and R-Residential to AG-Agricultural. Paul Hatcher is sworn in to speak. He stated the zoning changed without the family knowing in the 1980's and wants to have his horse on his property with the intention of a couple more horses, mini-cows and mini-goats (fenced in) in the future needing the zoning reverted back to agricultural. A letter was read into minutes from some neighbors on the concern of the quantity of animals on the property. Hatcher responds to the letter. Does not intend to board horses, no roaming animals, will take care of manure properly. This is a hobby. Sandeno questioned history of zoning of property. Miller explains in 1985- 1986 it was done and transferred to current maps and have no idea how it changed. Breisch elaborates by stating there was township meetings about it. Kristine Padavano is sworn in to speak about the concerns of the neighboring property line. Has concerns about quantity of animals, and he smell of manure. Miller explained manure shall be disposed of properly and if there is a complaint the property maintenance officer will be sent out. Hatcher explained again that it will be spread on his crops. Miller explains there can not be conditions put on agricultural land, can have options based on land size, and about fencing and buildings. Sandeno tells her it was the county's fault the zoning was changed. Miller will give Padavano a copy of the codes. Public comments closed.

There are no issues with any of the Lasalle Factors.

4. 23-ZBA-007 Variance for Additional Storage Building McNabb

Chairman Breisch read the petition and asked Miller to read the summery attached, she gave a synopsis of the petition for a variance to add an additional storage building to 2545 W Southmor Rd, Morris. A letter of support is read into minutes. John McNabb is sworn in and speaks on his own behalf, stated he needs the additional cold storage building to store cars and machines to keep out of weather and away from animals.

Cryer questioned where the owner of the letter came from, he's 1,200 feet away. No public comment. Breisch read rules of variance. No issue with any of the Lasalle Facotrs.

RESULT: APPROVED [UNANIMOUS]
