Federal judge rules Illinois assault weapons ban unconstitutional

A federal judge in East St. Louis has ruled that Illinois' ban on assault weapons is unconstitutional. The law, which was enacted in 2023, prohibits the sale and possession of certain semi-automatic firearms and high-capacity magazines.

Gun owners and advocacy groups immediately challenged the legislation, arguing that it violated constitutional rights. On November 8, Judge Stephen P. McGlynn sided with the plaintiffs, declaring the ban unconstitutional and granting an injunction.

However, the judge stayed this injunction for 30 days to allow for further legal proceedings. In response to the ruling, Illinois Attorney General Kwame Raoul filed an appeal on the same night.
