II. Approval of Minutes 

1. Zoning Board of Appeals Committee - Public Hearing - Nov 19, 2024 7:00 PM Channahon and Minooka spelt wrong - needed corrected.

III. Official Business 

1. Petition24-ZBA-010 Map Amendment A-Agricultural to AR-Agricultural Residential - Mark Hansen

Skwarczynski asked Miller to read summery for Petition 24-ZBA-010 Map Amendment A-Agricultural to AR-Agricultural Residential petitioned by Mark Hansen. Miller read summery. Skwarczynski asked

Miller if the lots were big enough to build houses on. Miller stated there is enough room for homes. Petitioner Mark Hansen said it was a good spot for homes. Dana Howd spoke to her opposition of adding the parcels for homes, removing the AG, wants it to remain AG. Howd mentioned RVs parked on land and parties ruining the rural feel of the land, has fears of incoming subdivision. Skwarczynski asked if the trailers were on that parcel. Howd said yes, there was 1. Skwarczynski asked how many houses there are to the east of proposed land. Howd gave no number. Brian Arnold asked about flood plain. Sabrina Hanson said she had the camper there on weekends. Howd has no complaints of neighbors. Hansen spoke of the flood plain, 100 year, 500 year and the flood way. Sandeno asked about how much area there is on the properties. Hansen stated you can build even if you are in flood zone. Miller stated on a crawl smart vents are needed, actual base flood elevation need to be high enough, and engineer would need engineering done prior to home permit. Skwarczynski asked what the set backs are. Miller stated that it is 50' from front, 50' from sides and rear to the foundation, AR is more restrictive then AG. Howd asked her letter to be read to record, Skwarczynski read into record. Public comment closed at 7:23pm. There are no concerns with any of the 8 LaSalle factors. Lynch asked if only one building permit per parcel. Miller verified yes. Sandeno asked of property to west. Miller stated that is less likely to build on that portion. Cryder asked of building permit for that property. Miller states there are none because of it being AG, does not affect these properties in petition. Motion approved, recommended to county board.

2. Petition 24-ZBA-011 Special Use for Sand Extraction Morris Sand & Gravel LLC

Skwarczynski asked MacDonald to read summary for Petition 24-ZBA-011 Special Use for Sand Extraction Morris Sand & Gravel LLC.

MacDonald read summary. Skwarczynski questioned the size of the parcel. MacDonald stated the total parcel at 80 acres. Sandeno questioned if the whole 80 would be mined. MacDonald stated the mining would be in a smaller portion. Petitioner Tim Hejny with Chamlin & Associates representing Morris Sand and Gravel, commented about the acreage is about 53 acres in conjunction with the prior special use will in total be 83 acres, bulk of mining will be on the north side of Cemetery Rd with small operation on south side of the road. Public comment closed at 7:42pm. There were no issues with any of the 8 LaSalle factors. Skwarczynski asked how many trucks a day go through there. 25 is the max. Skwarczynski asked the ZBA to look at all the 19 conditions. Move to recommend extraction with 19 conditions.
