Coal City Village Planning and Zoning Board met October 2.

Here is the minutes provided by the Board:

At 7 p.m. on Monday, October 2, 2017, chairman Georgette Vota called to order the regular meeting of the Coal City Village Board in the boardroom of the Village Hall, Roll cal-Members Maria Lewis, Max Waldez, Richard Crotteau, John Hawkinson and Irving DeWald. Also present were Matt Fritz, village administrator and Richard "Bob" Malone, building and zoning official.

The minutes of the September 18, 2017 meeting were presented, Lewis moved to approve the minutes as presented, second by Hawkinson. Roll call-Ayes; Lewis, Wota, Hawkinson and DeWald. Nays; none. Pass; Waldez and Crotteau. Motion carried.

Zoning Board Of Appeals

1. Variance Reduest

170 W. First Street

All those wishing to speak at the public hearing were sworn in by the Village Clerk. Mr. Fritz explained that the Petitioners are requesting a corner side yard variance for the construction of a six-foot privacy fence. The fence will extend towards DeWitt but still remain 10 feet within their own corner side yard. Petitioners agreed to have the utilities located if the variance is granted. Lot lines/boundaries have been located. Valdez moved to approve the variance request at 170 W. First Street for a 17 foot corner side yard variance for the construction of a six-foot privacy fence, second by DeWald. Roll callAyes; Lewis, Waldez, Crotteau, Wota, Hawkinson and DeWaid. Nays; none. Motion carried. The recommendation will be presented to the Village Board.

2. Conditional Use Permit

80 E. Division Street

Joe Hudetz, d/b/a Nice ce & Water H&H Enterprises, LLC

All those wishing to speak at the public hearing were sworn in by the Village Clerk. Mr. Hudetz is requesting the conditional use permit to installan automatic ice and water dispensing kiosk at the corner of E. Division Street and N. Kankakee Street, in the parking lot of Subway and Rosati's Pizza. The owner of the property, H&H Enterprises approves of the kiosk. Discussion and concerns were:

•Underground electrical will be run to the kiosk

•Garbage receptacles will be attached to the kiosk

•The size is 6.5 ft. x 16 ft,

•Similar ice houses are in Wilmington and Braidwood

•Bollards-supply doors will Swing freely between them-approximately 2 ft.

•Service doors-for supplies, mechanics

•Traffic-during the summer/25-50 cars per day

•Parking-business owners don't want to give up prime spots; proposed location is not in prime parking area

•24 hour service

•Waste water drains into the storm sewer

•Water purified by the reverse osmosis system

•Lighting & lamination discussed

The Board asked the Petitioner if another spot was considered and that they expressed concern for this structure being located in the Core Area and can it comply with the Core Area Design Standards, This Boards concerns included:

•Nice business idea, maybe not the right location Spot

•Safety for foot traffic

•Variance may be considered for nonconformity on top of the Conditional Use Reduest

•Moving unit closer to the east lot line

•Bollards not necessary on Kankakee Street and E. Division Street; only required on west side of parking lot and the end of the kiosk-north end

•Lighting-brightness

•Not an accessory use pertinent to the two restaurants

•Site of vision obstruction

Hawkinson moved to deny the Conditional Use Permit requested at 80 E. Division Street due to nonconformity, second by Lewis. Roll cal-Ayes; Lewis, Valdez, Crotteau, Vota, Hawkinson and DeWald. Nays; none. This Boards recommendation will be made to the Coal City Village Board.

The zoning code amendments will be discussed at a future meeting along with the updating to Chapter 150 of the Building Code.

Mr. Fritz announced that Hoffman Transportation will be approaching the Planning and Zoning Board regarding the rezoning of additional property they acquired on Reed Road from A-1 to i-1 in the near future. The walls of the new building will be in place on Wednesday.

Lewis moved to adjourn the meeting, second by Crotteau. All signified by saying aye. No one opposed. Motion carried. Meeting was adjourned at 7:45 p.m.
