Village of Coal City Planning and Zoning Board Met September 21

Village of Coal City Planning and Zoning Board met Sept. 21.

Here is the minutes provided by the board:

At 7 p.m. chairman Georgette Vota called to order the meeting of the Coal City Planning and Zoning Board. In attendance virtually were members Georgette Vota, Maria Lewis, John Hawkinson, Irving DeWald, Amanda Burns, Kyle Watson, deputy building inspector and Trustee Dave Togliatti. In attendance in the Village Hall via ZOOM were member Richard Crotteau and Matt Fritz, village administrator. Absent was member Jill Breneman.

The minutes of the June 15, 2020 meeting were presented. With a correction noted, Lewis moved to approve the minutes with the correction, second by Crotteau. Roll call-Ayes; Lewis, Crotteau, Vota, Hawkinson, DeWald and Burns. Nays; none. Absent; Breneman. Motion carried.

There was no Public Comment at this meeting.

ZONING BOARD OF APPEALS 

PUBLIC HEARING

Variance Request 

380 N. Kankakee Street 

Betsy Elberts

Clerk Noffsinger swore in the petitioner. Betsy Elberts was present virtually. Mr. Fritz explained that the petitioner is requesting a variance for the corner side yard of less than the required 25 foot set-back to install a 6 foot fence. The property is located on the southwest corner of North Kankakee Street and Fourth Street. The fence will be 18 feet off the house. The fence is made of PVC and can be seen through, and will contain her large dogs. There was no public comment. Hawkinson moved to recommend the variance request at 380 N. Kankakee Street as presented, second by Burns. Roll Call-Ayes; Lewis, Crotteau, Vota, Hawkinson, DeWald and Burns. Nays; none. Absent; Breneman. Motion carried. The recommendation will be presented to the Village Board at their September 23, 2020 meeting.

Conditional Use Presentation 

830 E. Division Street 

Doris Harrison

Ms. Harrison was present virtually. Mr. Fritz explained that Ms. Harrison, owner of the property at 830 E. Division Street is requesting the C-3 commercial property be converted into a hair salon. The property currently possessed a standards non conformity. A variance will be required due to the lot having a 73.6 foot frontage instead of the required 200 feet frontage. Parking was discussed at length. The front of the house, west driveway and rear parking will be asphalt. The house is approximately 1330 square foot. She is supplying 3-4 handicapped parking spaces in the front of the business, with a drive-way on the west side of the property to the rear of the property for additional parking of approximately 8-10 spaces. The beauty salon will have 4-5 chairs and the proper amount of spaces will be determined accordingly. There appears to be 17 feet between the structure and the west property line, of which there should be at least 20 feet. If that is the case, then a variance will be required for the drive-way. It was recommended that the petitioner acquire a survey in order for this Board to properly advise Ms. Harrison on her options. The Public Hearing is scheduled for October 5th,

Industrial Conditional Uses Presentation 

235 E. Oak Street · 

John Trotter

Mr. Trotter was present via ZOOM. Mr. Fritz explained that Mr. Trotter is the owner of 235 E. Oak Street. In 2017 Mr. Trotter received a conditional use to allow hauling, storage and processing of concrete recycling/gravel manufacturing. Stipulations were connected with the terms of that conditional use, on being the expiration in three years (2020), hours of operation and a set "crushing season." Mr. Trotter stated that he is requesting those conditions be extended for an additional five years and that the crushing season begin October 1st and end on April 1st, which includes 40 days of crushing, Mr. Trotter explained that he needs to complete the south side of the property with aggregate and backfilled to an elevation of 571 feet above sea level as stipulated in the original ordinance 17-02. Mr. Trotter explained that due to the weather and his farming occupation, the present limited crushing season is inhibited. He said that he will keep the present tree line located on the property. The public hearing for this request is scheduled for the October 5th meeting of the Planning and Zoning Board. (Mrs. Breneman came on virtually at 7:28 p.m.)

Mr. Fritz described the proposed Fourth Amendment to the Village's TIF (Tax Increment Financing) District which includes four primary areas. Mr. Fritz explained:

• Some of the areas included in the 4th Amendment will be annexed into the Village; those areas were identified and explained by Mr. Fritz

• Non-conformity lots exist and will be a part of the annexation

• A Public Hearing is scheduled for Thursday, September 24th at 5:30 p.m. in the Coal City Lions Hall

Mr. Fritz presented an update concerning the South Broadway Reconstruction project and alley blacktopping.

Mr. Hawkinson had several concerns with issues in the Village and possible revisions to the code. Among those concerns were car ports and cargo containers. Those concerns will be reviewed and addressed at later meetings.

DeWald moved to adjourn the meeting, second by Crotteau. Roll call-Ayes; Lewis,. Breneman, Crotteau, Vota, Hawkinson, DeWald and Burns. Nays; none, Motion carried. The meeting was adjourned at 8:30 p.m.
