Village of Coal City Planning and Zoning Board Met October 19

Village of Coal City Planning and Zoning Board met Oct. 19.

Here is the minutes provided by the board:

At 7 p.m., Chairman Georgette Vota called to order the meeting of the Coal City Planning and Zoning Board in the boardroom of the Village Hall. Roll call-Members Maria Lewis, Jill Breneman, Richard Crotteau, and Amanda Burns, Absent were Irving DeWald and John Hawkinson. Also in attendance were Matt Fritz, village administrator, Kyle Watson, deputy building inspector and Trustee Dave Togliatti.

The minutes of the October 5, 2020 meeting were presented and reviewed. Breneman moved to approve the minutes as written, second by Lewis. Roll call-Ayes; Lewis, Breneman, Crotteau, Vota, and Burns. Nays; none. Absent; DeWald and Hawkinson. Motion carried.

There was no public comment at this meeting,

ZONING BOARD OF APPEALS CONTINUED PUBLIC HEARING

Variance Request 830 E. Division Street Doris Harrison

Clerk Noffsinger swore in those asking to speak at the Public Hearing. Doris Harrison and Joshua Holloway were present for questions and comments. Mr. Fritz stated that this was a continued Public Hearing from the October 5, 2020 meeting in which residents voiced comments regarding the variance request. A new land use plan was distributed to the Board. Included in the discussion was:

• The Land Use Plan stipulates that the business at 830 E. Division Street and the business located at 810 E. Division Street will not be a joint venture between the two business owners and that each business will operate independently West side business at 810 E. Division Street disputes the boundary lines

The east resident submitted a letter regarding the variance request siting concerns regarding the drive-way between the two addresses and safety and privacy issues

The Petitioner noted the additions/changes to the original plan including:

• Single one-way drive way, entering on the east side of the business, around the north side, where the parking lot will be located, and exiting on the pinnar same driveway as the entrance; in essence looping around the 830 E. Division Street business; Lucas Paving are constructing the parking lot

• Drainage of the property will be located on the rear-north side of property Existing garage on the east side of the property will be removed Guardrails on the west and east side of the property will be placed Chairman Vota included:

• Zoning of the property is C-3

• The non-conforming status will remain on the property

Variance will include lack of sufficient amount of street frontage and set back requirements Drainage has to be addressed Lot line dispute is a civil matter Guard rails and possibly a fence/barrier on the east side for privacy to the homeowner

Lewis moved to approve the variance at 830 E. Division Street with a 129.9 foot frontage variance per C-3 zoning and the conditions consisting of placement of guard rails on the east and west side of the property and lighting issues/privacy with the neighbor on the east side, second by Crotteau. Roll call-Ayes; Lewis, Breneman, Crotteau, Vota and Burns. Nays; none. Absent; DeWald and Hawkinson. Motion carried. The recommendation will be made to the Village Board at their October 28th meeting.

VARIANCE PRESENTATION

Lot 16 & 17, Railroad Street Tim Norton

Tim Norton was present for questions and comments. Mr. Fritz explained that in 2007 a variance was adopted for a side yard set-back variance and the construction of a storage building. The then owner never constructed the building. To the north of the property is storage buildings. The property is zoned Industrial. The Petition in essence is asking to renew the variance for the same purpose. The Board discussion included:

• Property is located inside the core area and the Core Area Guidelines will be followed

• Metal buildings under 12,000 square feet are allowed

• Fencing of dumpsters; if applicable

• Lighting requirements

• Design of building

• Landscaping design

• Floor drains

• Drainage concerns

The Petitioner added:

• No driveway to be added

• No kitchen will be added

Placement of garage doors and access doors Bathroom to be installed; water & sewer are already on the vacant lot

The Board required that the Petitioner present a design of the intended structure by the date of the Public Hearing on November 16th.

Discussion was held regarding possible text amendments. Those amendments included signage, cargo containers, carports/portable garages and the addition of definitions for cafe/restaurant and the use of temporary use permits. Each of these recommendations will be addressed at future meetings.

Crotteau moved to adjourn the meeting at 7:48 p.m., second by Lewis. Roll call Ayes; Lewis, Breneman, Crotteau, Vota and Burns. Nays; none. Absent; DeWald and Hawkinson. Motion carried,
